State-Specific (Addendums)

  • PERSONAL TRAINING AGREEMENT (California)

    THIS PERSONAL TRAINING AGREEMENT (hereinafter, the "Agreement") is made and entered into on (Start Date): (End Date): by and between PHIT NATION, powered by Phase 1 Phitness (hereinafter, "Trainer") located in California, AND (Name) ____, (Rank) ____, (Unit) ____, (Address) ______________ (hereinafter, "the Client"). The TRAINER and the Client are collectively referred to as the "Parties."

    NOTE: Any Client under the age of 18 must have a parent or legal guardian co-sign this Agreement.

    State-Specific Addendum: California

    1. Right to Cancel

      • The Client has the right to cancel this Agreement within 3 business days after signing, with a full refund of any fees paid.

      • Cancellations must be in writing and delivered in person, via mail, or email.

    2. Refund Policy

      • In compliance with California laws, refunds will be provided for unused sessions upon termination, based on a pro-rated calculation of services already rendered.

    3. Virtual Training Compliance

      • Virtual training sessions offered must comply with California’s digital coaching regulations, ensuring secure data transmission and proper consent for recording (if applicable).

    All other clauses from the main contract are included here.

  • PERSONAL TRAINING AGREEMENT (New York)

    THIS PERSONAL TRAINING AGREEMENT (hereinafter, the "Agreement") is made and entered into on (Start Date): (End Date): by and between PHIT NATION, powered by Phase 1 Phitness (hereinafter, "Trainer") located in New York, AND (Name) ____, (Rank) ____, (Unit) ____, (Address) ______________ (hereinafter, "the Client"). The TRAINER and the Client are collectively referred to as the "Parties."

    NOTE: Any Client under the age of 18 must have a parent or legal guardian co-sign this Agreement.

    State-Specific Addendum: New York

    1. Refund Policy

      • Under New York state law, the Client has the right to request a refund for unused sessions in the event of termination, based on a pro-rated calculation.

    2. Right to Cancel

      • The Client has the right to cancel within 72 hours of signing, receiving a full refund of any fees paid.

    3. Consumer Protections

      • Phit Nation complies with New York’s consumer protection requirements, including full disclosure of terms, fees, and session validity.

    4. Data Protection

      • All personal and fitness data collected will comply with New York State privacy laws, ensuring confidentiality and protection of information.

  • PERSONAL TRAINING AGREEMENT (Texas)

    THIS PERSONAL TRAINING AGREEMENT (hereinafter, the "Agreement") is made and entered into on (Start Date): (End Date): by and between PHIT NATION, powered by Phase 1 Phitness (hereinafter, "Trainer") located in Texas, AND (Name) ____, (Rank) ____, (Unit) ____, (Address) ______________ (hereinafter, "the Client"). The TRAINER and the Client are collectively referred to as the "Parties."

    NOTE: Any Client under the age of 18 must have a parent or legal guardian co-sign this Agreement.

    State-Specific Addendum: Texas

    1. Virtual Training Requirements

      • Virtual training services offered in Texas will adhere to state guidelines, including proper client consent, secure online platforms, and clear communication of remote session terms.

    2. Right to Cancel

      • Texas law provides the Client the right to cancel this Agreement within 72 hours of signing, with a full refund of any fees paid.

    3. Remote Coaching Adjustments

      • If remote coaching is required due to deployment or PCS, Phit Nation will ensure compliance with Texas regulations on digital coaching, data privacy, and session recording (if applicable).

Environmental, Safety, and Occupational Health (ESOH) Compliance

  • Phase 1 Phitness LLC, operating as Phit Nation, is committed to adhering to all environmental, safety, and occupational health regulations to ensure a safe and compliant working environment for our staff, contractors, and the clients we serve. Below is an outline of our ESOH policies and expectations for all contractors working with or on behalf of Phit Nation.

  • All contractors must comply with applicable Government safety and health regulations, including but not limited to:

    • Public Law 91-596: Occupational Safety and Health Act (OSHA)

    • DoD Directive 4715.1E: Environmental, Safety, and Occupational Health (ESOH)

    • USAF Installation Safety Standards: When applicable, adherence to specific safety standards set by USAF installations is required.

    Contractors must establish and maintain a comprehensive safety and health program detailed in a written Safety and Health Plan. All subcontractors must also adhere to these standards, ensuring consistent safety practices across operations.

  • Contractors are required to implement and maintain a safety and health program that:

    • Is documented in a written Contractor’s Safety and Health Plan.

    • Outlines preventive measures, training programs, and emergency protocols.

    • Is made available to Phit Nation and relevant authorities upon request.

    This program must exceed basic compliance standards and ensure the safety of all personnel involved.

  • In the event of a mishap involving injury or damage to USAF assets or interests, the following steps must be taken:

    • Immediate Notification: Contact the Contracting Officer’s Representative (COR) or another designated Military Flight Team (MFT) member within two hours.

    • Scene Security: Secure the mishap scene and impound any maintenance and training records until released by the Government’s Safety Office (78 ABW/SE).

    • Accident/Incident Report: Submit a report within 24 hours of the mishap, using the form DI-SAFT-81563 (Accident/Incident Report).

    Contractors are expected to fully cooperate with Government personnel during investigations and provide all necessary support.

  • All contractor personnel performing work on USAF installations are required to participate in the local Voluntary Protection Programs (VPP). This program, created by OSHA, recognizes worksites that have exemplary systems for managing worker safety and health.

    4.1 VPP Description

    OSHA’s Voluntary Protection Programs (VPP) encourage worksites to implement comprehensive Safety and Health Management Systems that exceed basic OSHA compliance. VPP is applicable to all personnel, including civil servants, active duty, reservists, and contractors.

    Contractors must:

    • Have a thorough understanding of VPP principles.

    • Ensure their safety practices align with the Air Force installation’s pursuit of VPP recognition.

    • Access the OSHA VPP website for more information: OSHA VPP Website.

  • Contractor operations may be inspected by Department of Labor (DoL) officials, specifically OSHA health and safety officers. These inspections can occur at any time and may be scheduled or unscheduled.

    • Contractors must immediately notify the COR and the unit’s Safety Office upon notification of a DoL inspection.

    • OSHA officials must meet all security requirements to access restricted or classified areas.

Compliance Statement for Military Base Access and Background Checks

  • At Phase 1 Phitness LLC, we are committed to maintaining the highest standards of security and compliance when working with the United States military. As a contracted fitness trainer, your role may involve working on military installations and interacting with military personnel. To ensure the safety and integrity of military operations, specific security protocols must be followed.

  • All trainers who are assigned to provide services on military bases are required to undergo a background check conducted by the Defense Counterintelligence and Security Agency (DCSA) or the designated security office of the base. This background check is a mandatory part of your assignment and may include comprehensive investigations, such as a review of national agency records, local law enforcement checks, and credit history. You will be required to complete security questionnaires, including the Standard Form 86 (SF-86), using the Electronic Questionnaires for Investigations Processing (e-QIP) system.

  • To gain access to military facilities and DoD systems, you must obtain a Common Access Card (CAC). The process for CAC issuance includes identity verification and may require fingerprinting and other security measures. It is your responsibility to meet all requirements for CAC issuance and to carry your CAC at all times when on duty at a military installation.

  • While working on a military base, you are expected to adhere strictly to all security protocols, base regulations, and professional conduct standards. This includes respecting dress codes, following restricted area guidelines, and complying with any instructions provided by military personnel. Any violation of these rules or failure to meet security requirements may result in the immediate termination of your assignment or contract.

  • Your work on military installations may expose you to sensitive or classified information. It is crucial to maintain the confidentiality of any information you come across and to handle all data and communications with the utmost discretion. If you encounter any security concerns or breaches, you must report them immediately to the appropriate authorities.

  • The background check process can be time-sensitive, and it is essential that you complete all required forms and respond to any requests from the investigating agency promptly. Cooperation and transparency during this process are vital. Delays, non-compliance, or failure to provide accurate information can impact your ability to fulfill your duties on military bases.
